• Deposits: The deposit starts at $150 per person and can go up to $350 per person; regardless of the purchase of insurance, deposits are NOT refundable for X2P group trips.

• Payments:  Payments are made at your own leisure with the exception of important dates which will be outlined on your booking confirmation; these dates vary by trip. Though optional, we encourage you to make small payments leading up to the final payment date on your confirmation. A monthly payment plan is available for those that are interested. Payments can be made on our website.

  • All payments for Xscape2Paradise (X2P) Group Trips are non-refundable and non-transferable. 

  • Payments can be made in one lump sum or broken up over time as long as you meet the minimum by each date listed. There are no extensions available for the final payment date. 

• Name Changes: Name changes are permitted for $100 per person and must be completed no later than 60 days prior to the date of travel. At least one passenger from the original reservation must remain in the room. Changing all names on a room is not permitted and considered a cancellation. Name Changes are not permitted for single occupancy reservations, cancellation penalties will apply. Name changes can only be made with people not currently booked on the same group trip. Please contact Xscape2Paradise for more assistance with name changes. 

• Cancellation Policy: All payments for Xscape2Paradise (X2P) Group Trips are non-refundable and non-transferable. Our contractual agreements with hotels, airlines and other travel vendors will not allow us to obtain refunds after booking to guarantee our group discounts; we strongly recommend the purchase of travel insurance to protect your vacation investment. If interested in purchasing travel insurance, please work with Seantay, your Xscape2Paradise Travel Agent, for a quote. There are no exceptions to our cancellation policy. Vacation protection only protects payments after the initial deposit, and does not cover the non-refundable deposit as per our non-refundable deposit policy. Please read the cancellation policies in it's entirety as this cancellation policies may differ from the standard policies of other suppliers. ALL NO SHOWS WILL BE ASSESSED A 100% CANCELLATION FEE.  If a missed flight or any other delay - for any reason prevents you from attending, you will be responsible for re-booking a different flight or you will be considered a no-show. Please note that your decision not to travel due to State Department advisories or fear of travel will constitute a cancellation by you; no refund or credit will be given for any unused features or early departures for any reason. The purchase of Travel Insurance is strongly recommended to protect your vacation investment in the event of a "what if " happens. It is better to have travel insurance and not need it than to need it and not have it! A “cancel for any reason” policy is recommended. Anyone that cancels, must do so in writing (via email) - an email is required from each person that is canceling, with the exception of married couples.

• Responsibility Clause: Xscape2Paradise acts only as agent for the various carriers for which tickets are provided and assume no responsibility or liability in connection with the service for any vessel, carriage, motor vehicle or other conveyance which may be used wholly or in part, in the performance of its duty to passengers; neither will they be responsible for the vehicle, or through neglect or default of any company or person engaged in conveying the passenger. Xscape2Paradise shall not be responsible for any breach of contract. Xscape2Paradise will ensure that you are promptly notified of any significant changes once we become aware of such change if there is time before your departure, but we accept no liability for any changes or costs incurred that may result.

• Acceptable Use: It is a violation of law to purchase a product in a false name or with an invalid credit card. Please be aware that even if you do not give us your real name, your web browser transmits a unique Internet address to us that can be used by law enforcement officials to identify you. Fraudulent users will be prosecuted to the fullest extent of the law.

• Travel Documents: Passports ARE required for international travel. You can find more information for each destination by visiting https://travel.state.gov/content/travel/en/international-travel.html

• Travel Service Limitation of Liability: Xscape2Paradise is acting as an agent for airlines or other travel service providers (collectively, “Travel Suppliers”) in selling travel services, or in accepting reservations or bookings for such services to be provided to you. Xscape2Paradise does not assume liability for any injury, damage, death, loss, or delay due to an act of negligence or the default of a Travel Supplier, or by an act of God. Further, no responsibilities are accepted for any damage and/or delay due to sickness, pilferage, labor disputes, machinery breakdown, quarantine, government restraints, weather or causes beyond Xscape2Paradise’s control. No responsibility is accepted for any additional expense, omissions, delays, re-routing or acts of any governmental authority. The contract of carriage in use by a Travel Supplier, when issued, shall be between the Travel Supplier and the passenger. Xscape2Paradise is not responsible for any transportation cost incurred under any circumstances.

• General Limitation of Liability: IN NO EVENT SHALL Xscape2Paradise, INCLUDING ITS OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, AFFILIATES, OR PROVIDERS (COLLECTIVELY, THE “COVERED PARTIES”), BE LIABLE FOR ANY INJURY, DEATH, LOSS, CLAIM, DAMAGE, ACT OF GOD, A DENT, DELAY, OR ANY SPECIAL, EXEMPLARY, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, WHETHER BASED IN CONTRACT, TORT OR OTHERWISE, WHICH ARISE OUT OF OR ARE IN ANY WAY CONNECTED WITH ANY USE OF THIS SITE OR WITH ANY DELAY OR INABILITY TO USE THIS SITE, OR FOR ANY INFORMATION, SOFTWARE, PRODUCTS OR SERVICES OBTAINED THROUGH THIS SITE, EVEN IF Xscape2Paradise HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Further, the Covered Parties accept no responsibilities for any damage and/or delay due to Provider cancellations, shortages, sickness, pilferage, labor disputes, machinery breakdown, quarantine, government restraints, weather or causes beyond the Covered Parties’ control. No responsibility is accepted for any additional expense, omissions, delays, re-routing or acts of any governmental authority. No Covered Party shall be responsible for any Provider’s breach of any warranty including, but not limited to, implied warranties of fitness for a particular purpose or of merchantability, nor shall any Covered Party be responsible for any other wrongdoing of a Provider (including any liability in tort), as to any products and/or services available through this Site. No Covered Party shall be responsible for any Provider’s failure to comply with these Terms and Conditions nor for any Provider’s failure to comply with applicable federal, state and local law including, without limitation, laws governing the sale, warranty, and return of perishables. If, notwithstanding the above, a Covered Party is found liable for any loss or damage relating to the use of this Site, User agrees the liability of any such party shall in no event exceed the fee or charge to the User assessed by Xscape2Paradise for making a Purchase. Some states, to the extent their law might be deemed to apply notwithstanding the selection of Florida law as described below, do not allow the limitation of liability, so the foregoing limitations might not apply to you.

• Terms and Conditions that Specifically Apply to Vacation Services: Xscape2Paradise, the selected host resort for each destination and any parties that they transfer rights to, has the exclusive right to include photographic, video and other visual portrayals of travelers/clients in any pictorial medium of any nature whatsoever for the purpose of trade, advertising, sales, publicity or otherwise, without compensation to traveler/client, and all rights, title and interest therein (including all worldwide copyrights therein) shall be Xscape2Paradise sole property, free from any claims by traveler/client or any person deriving any rights or interest from Passenger. Specific events and excursions subject to change. Participation is subject to Terms and Conditions ofour host resort. By booking this Xscape2Paradise group trip, you (the passenger) agree to release and hold harmless Xscape2Paradise, and their respective officers, directors, members, managers, principals, employees, representatives, attorneys, insurers, reinsurers, successors, assigns, and agents, (collectively, the Released Parties) from and against any claim or cause of action arising out of or in connection with your travel on and participation on this group trip, including, but not limited to: (1) injury, death or delay of passengers, or loss, damage or delay of or to passengers’ baggage or other property, which may be caused, directly or indirectly, in whole or in part, from participation in this Xscape2Paradise group trip, including, without limitation, passenger’s use of or participation in any shore excursion, on board concession or athletic or recreational activity; (2) lost or incorrect reservations; (3) emotional distress, mental suffering or anguish or psychological injury of any kind under any circumstances (except when such damages were caused by the Released Parties’ negligence and resulted from the same passenger’s sustaining actual physical injury, or having been at risk of actual physical injury, or when such damages are held to have been intentionally inflicted by the Released Parties); (4) any change in scheduled events and/or celebrity appearances; or (5 ) Our host resort(s) exercise of its contractual rights. You further agree that the Released Parties shall not be held vicariously liable for the intentional or negligent acts of any persons employed by any of the Released Parties, nor for any intentional or negligent acts of any of the Released Parties’ employees committed while off duty or outside the course and scope of their employment. Except where prohibited, you (the traveler/client) agree that: (1) any and all disputes, claims and causes of action arising out of or connected with the Xscape2Paradise group trip, shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of Tennessee; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with the group trip, but in no event attorneys’ fees; and (3) you waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct or indirect damages. Xscape2Paradise reserves the right to deny or revoke service or participation privilege to any guest for any reason we deem necessary. This includes any circumstance where the health or well being of any or all guests is threatened or endangered.

• Itineraries: Both Xscape2Paradise and the host resort has reserved the right to cancel or change itineraries at any time. All events, and talent, are subject to change; this goes for itineraries created by Xscape2Paradise as well. If for any reason Xscape2Paradise has to change the vacation destination, a new destination will be selected and we will do our best to keep the package cost as close to possible as the original cost. A vacation package is defined as airfare, resort accommodations and airport transportation. Changes to itineraries and destination does not warrant the ability for registrants to cancel without penalty as we are still under contracts with our suppliers and will do all that we can to make comparable changes to the vacation package.

• Indemnification: You agree to indemnify us and our affiliates, and any of our Suppliers, and any such parties’ officers, directors, employees and agents from and against any claims, causes of action, demands, losses, damages, or other costs, (including reasonable legal and accounting fees) brought by you or third parties as a result of (a) your breach of this Agreement, (b) your violation of any law or rights of any third party, or (c) your use of our website.

• Agreement: By booking your travel arrangements with Xscape2Paradise, you are agreeing to be bound by all terms of this agreement and any additional terms and conditions of any Supplier that are applicable to your booking, travel arrangements or use of any website content. You agree on behalf of yourself and those you represent as part of your travel group to comply with all such terms and conditions, including the payment of all amounts when due. You agree that any violation of any such terms and conditions may result in (a) the cancellation of your reservation or purchase (b) your forfeiture of any monies paid for your reservation or purchase (c) you being denied access to the applicable travel related product or service, and (d) our right to debit your account for any costs we incur as a result of such violation. You represent and warrant that (a) you are of sufficient age to use our services and website and can create binding legal obligations in connection with your use, (b) you are legally authorized to act on behalf of those you represent and accept these terms and conditions on their behalf, and (c) the information supplied by you or members of your group is true and correct. You are responsible for informing such other persons of all terms and conditions applicable to their travel arrangements. You understand that you are financially responsible for any use of our services or website by you and those using your name or account. Xscape2Paradise is acting as an independent contractor and no joint venture, partnership or employment relationship exists between you and us or our Suppliers as a result of this Agreement or your use of our website. We reserve the right at any time to modify this Agreement without prior notice to you. Please refer to our website at www.Xscape2Paradise.com from time to time to review the most current version of the terms and conditions agreement. Your continued access or use of our website or services signifies your acceptance of the modifications to the terms and conditions. You may not assign your rights or obligations under this agreement to any third party. We may terminate this agreement at any time for any reason, and such termination shall not affect any right to relief to which we are entitled at law or in equity. This agreement shall be governed by the laws of the State of Tennessee without regard to its conflicts of laws principles. If any provision of this agreement is found to be invalid, illegal or unenforceable, the enforceability of the remaining provisions will not in any way be affected or impaired.

• Final Balance Due Date: ALL money due must be paid in full by the set due date outlined for each group trip - NO EXCEPTIONS
